TERMS OF USE

General

This agreement governs the use of all Gottesman Libraries applications and content. Gottesman Libraries applications are operated by Teachers College, Columbia University in the City of New York at 525 West 120th Street, New York, New York 10027. Additional terms and conditions may be posted in specific applications, and along with this agreement, govern use of those applications. This agreement and other additional terms and conditions are referred to as the "Agreement."

Right to Modify Terms and Conditions

Teachers College reserves the right to change or modify this Agreement at any time. Such changes will take effect immediately upon publication of the changes on this site. Use of Gottesman Libraries applications constitutes binding acceptance of the terms and conditions in the Agreement and any other posted

Account Information, Password, and Security

Users are responsible for maintaining the confidentiality of their account and password. Users are solely responsible for any and all activities that occur under their account and agree to notify us of any unauthorized use of their account or other breach of security.

Rights to Content

Users of Gottesman Libraries applications acknowledge that our applications contain text, photographs, audio and video clips, graphics, software, links, discussion comments, and other materials that are protected by copyright, trademark, patent, and other rights of Teachers College or third parties.

Personal and Non-Commercial Use Limitation

Users of Gottesman Libraries applications may use the materials only for their personal, noncommercial use. Users may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, or services obtained from Gottesman Libraries applications.

Rights to Materials Posted by Users

Users may post content on Gottesman Libraries applications owned by them such as original statements, content that is in the public domain, or content owned by others for which they have received express permission. Users assume complete responsibility for determining if content they post is in the public domain. Users grant to Teachers College and any sublicensees the right to edit, copy, publish, distribute, translate, or otherwise use, in any medium now available or yet to be invented, content they place on Gottesman Libraries applications and to publish the name of the user posting the content. Users represent and warrant that they are authorized to grant such rights. Unless otherwise specified in a copyright assignment agreement governing submitted content, no compensation will be paid with respect to the use of content placed by users.

Rules of Conduct

Users shall not post on Gottesman Libraries applications any content or links to content that violates the rights of others, including but not limited to content that infringes any copyright, trademark patent, trade secret or that violates any right of privacy or publicity. Users shall not post on Gottesman Libraries applications any content or links to content that is libelous, defamatory, obscene, pornographic, abusive, harassing, or threatening. Users shall not post on Gottesman Libraries applications any content or links to content that contains viruses or other contaminating or destructive features. Users shall not post on Gottesman Libraries applications any content or links to content that violates any applicable law.

Management of Content

Other than scholarly articles submitted through the manuscript submission system, Teachers College does not review the content posted by users and is not responsible for such content. At its sole discretion, Teachers College does reserve the right to edit, move, or remove any content, including content posted in any interactive area, that it may determine violates this Agreement or is otherwise unacceptable. Users are solely responsible for all content posted under their account and password. At its sole discretion, Teachers College shall have the right, but not the obligation, to correct any errors or omissions in any content.

Indemnification

Users agree to indemnify, defend, and otherwise hold harmless, Teachers College, and other information providers featured on Gottesman Libraries applications against any and all claims, liabilities, losses, costs and expenses, including attorney’s fees, incurred in connection with any use of Gottesman Libraries applications under their password by any person, whether or not authorized by the user. Teachers College reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by users, and users agree to cooperate with Teachers College’s defense of such claims. Teachers College will not be liable for any loss that users may incur from the unauthorized use of their account. Users are liable for any loss that Teachers College may suffer as the result of the authorized or unauthorized use of their account. Users may not use the account of another user at any time without the permission of the account owner.

Termination of Use

Teachers College reserves the right to restrict, suspend or terminate user access to Gottesman Libraries applications at any time for any reason without prior notice or liability. Teachers College may modify, suspend or discontinue all or any part of Gottesman Libraries applications at any time without prior notice or liability.

Disclaimer of Warranties

Neither Teachers College nor any provider of third party content nor their respective agents warrants that Gottesman Libraries applications will be uninterrupted or error free. Neither Teachers College nor any provider of third party content nor their respective agents makes any warranty regarding the results to be obtained from the use of Gottesman Libraries applications or the materials contained therein. Gottesman Libraries applications are provided and distributed on an "as is, as available" basis. Neither Teachers College nor any provider of third party content nor their respective agents make any warranties of any kind, either express or implied, including, without limitation, warranties of title or implied warranties of fitness for a particular purpose, with respect to any materials provided by or announced through Gottesman Libraries applications. Neither Teachers College nor any provider of third party content nor their respective agents warrants that any files available for downloading or streaming through Gottesman Libraries applications will be free of viruses or similar contamination or destructive features. Users agree to assume the entire risk associated with the quality and performance of Gottesman Libraries applications and the accuracy and completeness of content provided on Gottesman Libraries applications.

Neither Teachers College nor any provider of third party content nor their respective agents shall be liable for any damages arising out of the use or inability to use Gottesman Libraries applications whether such damages be direct, indirect, incidental, special or consequential, even if such parties have been advised of the possibility of such damages.

In states that do not allow exclusion of implied warranties or limitation of liability for incidental or consequential damages, the liability of Teachers College, third party content providers and their respective agents shall be limited to the greatest extent permitted by law. If users are dissatisfied with any portion of Gottesman Libraries applications, or with any of these terms and conditions of use, the sole and exclusive remedy is to discontinue using Gottesman Libraries applications.

Jurisdiction

This agreement shall be interpreted and construed in accord with the laws of the State of New York, and the parties irrevocably consent to bring any action to enforce this Agreement in the federal or state courts located in New York, NY, the Borough of Manhattan.

PRIVACY POLICY

What is Our Approach to Privacy?

We gather information on visitors to improve the performance of applications and the experience of visitors, and to conduct research that advances our understanding of learning and teaching. We take all possible steps to minimize the intrusiveness of any data gathering and to disclose fully all policies and practices regarding the collection, management, and use of such information. In addition, we provide visitors with the opportunity to control the personally identifiable information provided to Gottesman Libraries applications and to modify that information when necessary.

What information is collected and how is it used?

For each visitor to our applications, our servers automatically recognize your domain, service provider, operating system, and browser. Our server additionally records usage of pages and resources by our visitors. We use this information, in aggregate, for our research reports and performance surveys. We sometimes use this non-personally identifiable information that we collect to improve the design and content of our site and to enable us to personalize your Internet experience.

At no time will we disclose to third parties any one person's pattern of application use. However, we reserve the right to disclose aggregate browsing statistics to interested third parties.

Some Gottesman Libraries applications collect personally identifiable information to further personalize your experience within an application. Some applications require that you provide personally identifiable information in order to participate in the activities and offerings within.

We may use the information you provide about yourself to fulfill your requests for resources and services, to respond to your inquiries, and to recommend educational resources and services that may be of interest to you. We may also use this information to communicate with you, such as to notify you when we make changes to our services, to fulfill a request by you, or to contact you about your account with us. Most of our communications provide an "opt-out" feature.

We may also use your information to update internal systems. This allows for seamless delivery of services and resources to you across the Gottesman Libraries.

What organization is collecting the information?

Gottesman Libraries applications are owned by Teachers College Columbia University. All information gathered by Gottesman Libraries applications is the property of the Trustees of Teachers College.

With whom is the information shared?

Information gathered on visitors to Gottesman Libraries applications is currently held exclusively by Teachers College. In the future we may share aggregate information on the traffic on our site with sponsoring organizations. If we receive requests for individually identifiable information on the users of our site, we will only release such information after seeking and obtaining the permission of individual users. We intend to give visitors to our site control over the ways in which the information they provide is used.

What security procedures are in place to protect against the loss, misuse, or alteration of information under our control?

Information on visitors to Gottesman Libraries applications remains on the web server and is accessible only to the Teachers College staff members charged with particular tasks requiring such information. For instance, site traffic information is used by staff members responsible for preparing periodic site traffic reports, and individual e-mail information is used by staff members responsible for issuing the periodic e-mail newsletter. On our secure server(s), we use industry-standard Secure Sockets Layer ("SSL") technology to guarantee the confidentiality of online transactions made on our site. SSL authentication and encryption of the information that you send to us over the Internet helps protect your online transaction information from third party interception. We urge you to protect your own privacy. We recommend that you do not share any account information or passwords used to access Gottesman Libraries applications. We would never request your password from you. Although we take appropriate measures to safeguard against unauthorized disclosures of information, we cannot assure you that personally identifiable information that we collect will never be disclosed in a manner that is inconsistent with this privacy policy.

What choices are available to you regarding collection, use and distribution of the information?

No personal identifiable information is collected from unregistered users other than standard server information such as their referring IP address and other "header" information. Such unregistered users have no need, and therefore, no opportunity to alter or delete information.
